WAVES RUSH IN GIVEAWAY

  1. This prize draw will be governed by these terms and conditions (the “Terms”) and entrants agree that they have read and understood these Terms and will be bound by them. 
  2. The opening date for entries is 00:01 GMT on Monday 09 October 2023 (the “Opening Date”). 
  3. The closing date for entries is 23:59 GMT on Sunday 10 December 2023 (the “Closing Date”).
  4. The competition is open to worldwide applicants.
  5. The winner will be selected on Monday 11 December 2023. 
  6. Entrants may enter the prize draw by entering their details into the form at https://wavesrushin.com/competition.
  7. By entering this competition, you agree to receive marketing emails and updates as part of the Waves Rush In mailing list.
  8. Duplicate entries will be removed.
  9. The winner shall be contacted ahead of receiving their prize to determine the desired size and colour (where relevant) of any relevant items included within the prize package.
  10. The winner is responsible for all applicable taxes and expenses not specified in the Prize description. 
  11. The winner will be notified individually by email within seven (7) days after the winner is selected. Upon notification the winner will be asked to confirm their name, age and e-mail address and provide an address (including postcode) and telephone contact number. 
  12. In the event that the Promoter cannot for any reason establish contact with a winner within seven (7) days of the Promoter’s initial attempt to do so, or the winner does not wish to receive the Prize, then the Promoter reserves the right to select a reserve winner.
  13. The Promoter reserves the right to select an alternative winner in the event that the Promoter has reasonable ground for believing that a selected winner has contravened any of these Terms. 
  14. The Promoter reserves the right to terminate the prize draw and withhold the Prize in the event that, in the Promoter’s opinion, there are insufficient entries for the Promoter to be able to select the winner or where, in the Promoter’s opinion, improper conduct by an entrant (or any number of them) has rendered the prize draw unfair to all entrants. The Promoter’s decision is final with respect to any aspect of the prize draw, including the determination of the winner of the Prize. No correspondence will be entered into. If for any reason the promotion is not capable of running as planned for reasons including but not limited to tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right (subject to any written directions given under applicable law) to disqualify any individual who tampers with the entry process and to cancel, terminate, modify or suspend the promotion or invalidate any affected entries but will endeavour to minimize the effect to entrants in order to avoid undue disappointment. 
  15. The Promoter can accept no responsibility for entries delayed, misdirected or undelivered. Incomplete entries will be disqualified. The Promoter shall not be responsible for technical errors in telecommunications networks, Internet access or otherwise preventing entry to any competition or prize draw. 
  16. The Prize is as stated and is non-refundable and non-transferable. No cash alternatives will be offered. If the winner elects not to, or is unable to, use part of the Prize, the winner will forfeit that part of the Prize. If due to circumstances beyond the Promoter’s control the Promoter is unable to provide the stated Prize, the Promoter reserves the right to withdraw the Prize at any time.
  17. The Promoter shall not be liable for any loss or damage howsoever caused (whether in contract, tort or statutory duty or otherwise) arising out of or in connection with the prize draw and/or any prize other than death or personal injury caused by negligence of the Promoter and/or the Promoter’s personnel and/or deceit or fraud by Promoter and/or its personnel. 
  18. The Promoter shall not be liable for any delay in performing or partial or total failure to perform any of its obligations to the winner under these Terms and Conditions if such delay or failure is caused by circumstances beyond its reasonable control including without limitation delays (to postal services or otherwise), changes, disruptions, cancellations, diversions or substitutions howsoever caused including without limitation as a result of war, terrorist action Page 3 of 4 or threatened terrorist action, strikes, hostilities, civil commotions, accidents, fire, flood or natural catastrophes. For the avoidance of doubt, the affected winner shall be solely liable for any additional costs incurred as a result. 
  19. Each provision excluding or limiting liability is to be construed separately and will apply and survive even if for any reason any of the other provisions are held to be inapplicable or unenforceable in any circumstances. Each of the provisions excluding or limiting liability will remain in force notwithstanding any termination of these Terms. 
  20. The surname and country of the winner can be obtained by sending a stamped, self-addressed envelope to: Waves Rush In, c/o Whole Management, Metropolis Studios, The Power House, 70 Chiswick High Road, London, W4 1SY for one (1) month after the prize draw closes. The winner has the right to withdraw their permission to have their surname and county published. 
  21. Any personal information, including without limitation, the entrant’s name, age, address (including postcode), telephone number and/or e-mail address will be used solely in connection with this prize draw and for any purpose for which the entrant specifically opts in and will not be disclosed to any third party except for: (a) the purpose of fulfilling the Prize where applicable; and (b) for any purpose for which the entrant specifically opts in. Any personal information held by the Promoter in respect of any competition or prize draw will be held on record for a reasonable period to fulfil the purpose for which such personal information was collected and used in accordance with the Promoter’s “Privacy Policy” set out at https://wavesrushin.com/privacy-policy. To request a copy of the Privacy Policy, ask a privacy question, or exercise your privacy rights, you can write to the Promoter by post to the Promoter’s address above, marked for the attention of The Data Protection Officer or visit: https://wavesrushin.com/privacy-policy. If an entrant gives the Promoter permission to pass on their personal information to a third party then this shall no longer be the responsibility of the Promoter and shall be subject to the privacy policy of that third party. 
  22. If any provisions of these Terms are judged to be invalid, illegal, or otherwise unenforceable, then its shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect.
  23. These Terms shall be governed by and construed in accordance with the laws of England and Wales and any disputes shall be subject to the exclusive jurisdiction of the English Courts.
