NAG SHAMPA PRIZE DRAW

This prize draw will be governed by these terms and conditions (the “Terms”) and entrants agree that they have read and understood these Terms and will be bound by them.

The opening date for entries is 00:00 GMT on Friday 02 January 2023 (the “Opening Date”).

The closing date for entries is 23:59 GMT on Friday 30 June 2023 (the “Closing Date”).

Entrants may enter the prize draw by purchasing at least one (1) copy of ‘Under The Static – 12” Vinyl – Deluxe Edition” directly from wavesrushin.com or store.wavesrushin.com at any time between the Opening Date and the Closing Date. This includes: (a) any pre-order purchase ahead of the release date; and (b) confirming that you have read and accepted these Terms. Entrants may also enter by posting a video of themselves drawing the Waves Rush In ‘shell’ icon (as seen on the wavesrushin.com home page) to their Instagram account; the posted video must (a) contain the audio of either ‘Watch You Glow’ or ‘7 Billion’ by Waves Rush In, applied only using the native Instagram music function; and (b) include @wavesrushin #underthestatic #comingsoon as tags in the post’s description at any time between the Opening Date and the Closing Date. The entrant’s post must be visible to the general public on the entrant’s Instagram account at the date the winner is drawn. Any entry received via Instagram shall be considered as confirmation that the entrant has read and accepted these Terms.

To enter the prize draw, entrants must fulfill each of the following criteria: (a) own a valid passport; (b) be eighteen (18) years old or over; (c) have no criminal record; and (d) not be an employee or immediate relative of an employee of the Promoter and/or the Promoter’s respective parents, subsidiaries or affiliated companies or any other person professionally connected with this prize draw.

Upon checkout of your purchase, you will be given the opportunity of opting in to receive marketing updates from Waves Rush In (the “Promoter”). It is not mandatory to opt in to enter this prize draw. Only tick this box if you consent to providing your personal details for the purpose of receiving marketing information from the Promoter.

The winner will be selected at random by the Promoter via an independent computer programme from all valid entries which are received on or before the Closing Date.

The winner will receive for themselves and one (1) guest a trip to the privately owned luxury Nag Shampa Estate in Taro, Bali, which shall include: (a) seven (7) nights accommodation; (b) economy class return air travel tickets to/from Bali; (c) airport transfers on dates of arrival and departure; (d) daily breakfast (e) two (2) balinese massages per day; and (f) all non-alcoholic beverages; together, the “Prize”. The total combined cost of flights for the winner and their guest shall not exceed two thousand five hundred pounds sterling (£2,500).

Entrance into the prize draw is equal to the cost of a qualifying purchase (Term 4) and any associated connectivity costs, such as the internet. Those costs may vary so please check with your service provider for current charges. Entrants should seek the permission of the person paying the bill before entering.

Every qualifying purchase counts as one (1) entry into the prize draw, except if it becomes apparent that an entrant is using a computer(s) to circumvent this condition by, for example, the use of ‘script’, ‘brute force’, masking their identity by manipulating IP addresses, using identities other than their own or any other automated means in order to increase that entrant’s entries into the promotion in a way that is not consistent with the spirit of the promotion, that entrant’s entries will be disqualified and any prize award will be void.

The Promoter reserves the right to contact any and/or all entrants using the e-mail address provided on entry throughout the term of the prize draw in relation to these Terms and the Prize.

The winner will be selected on 1 July 2023.

For the avoidance of doubt, the Prize does not consist of anything other than expressly set out in Term 8 above and no additional costs are included. The winner and the winner’s guest(s) will be responsible for organising and paying for transfers to and from the departure airport. The Prize does not include: meals and drinks other than those expressly stated in Term 8, excursions, attractions, treatments, car hire, visas, spending money or gratuity; additional accommodation, testing or ancillary medical costs associated with winner’s compliance with COVID guidelines issued by their home and/or departure country and/or the United States; or any other expenses incurred as a result of claiming the Prize.

The winner and the winner’s guest(s) must hold passports valid for at least six (6) months on the date of travel and any other necessary travel documentation (including, without limitation, visas where necessary).

Travel insurance is the responsibility of the winner and/or their guest(s).

THE WINNER AND THE WINNER’S GUESTS MUST BE AVAILABLE TO TRAVEL TO BALI, WITHIN SIX (6) MONTHS OF THE DATE OF NOTIFICATION OF BEING A WINNER. NO ALTERNATIVE DATES OR CASH ALTERNATIVE WILL BE AVAILABLE.

The accommodation is only available at certain times of the year. The promoter will contact the winner with a number of available dates no later than one (1) week after the winner has been drawn. A chosen date must be accepted and agreed within two (2) weeks from the date that the winner was contacted. The booking must take place in 2023. Once booked, the Prize cannot be amended or cancelled.

Flights may include hand luggage only, may be indirect and not all routings will be available. Flight itinerary will be selected by the Promoter at their sole discretion, and the winner and their guest(s) must travel at the same time with the same itinerary. At least one (1) traveller must be aged twenty-one (21) or over. Children under eighteen (18) will require parent or guardian permission prior to travel.

The winner and their guests will be required to comply with all COVID entry requirements and specific COVID requirements of the Indonesian government and/or local authority rules updated from time to time: https://www.dfa.ie/travel/travel-advice/a-z-list-of-countries/indonesia/

The winner and their guest(s) may each be required to provide a written acknowledgement of acceptance of all the Terms of this prize draw prior to receiving the Prize.

The winner is responsible for all applicable taxes and expenses not specified in the Prize description.

The winner will be notified individually by email within seven (7) days after the winner is selected. Upon notification the winner will be asked to confirm their name, age and e-mail address and provide an address (including postcode) and telephone contact number.

In the event that the Promoter cannot for any reason establish contact with a winner within seven (7) days of the Promoter’s initial attempt to do so, or the winner does not wish to receive the Prize, then the Promoter reserves the right to select a reserve draw at the same time as the original winner.

The Promoter reserves the right to select an alternative winner in the event that the Promoter has reasonable ground for believing that a selected winner has contravened any of these Terms.

The Promoter reserves the right to terminate the prize draw and withhold the Prize in the event that, in the Promoter’s opinion, there are insufficient entries for the Promoter to be able to select the winner or where, in the Promoter’s opinion, improper conduct by an entrant (or any number of them) has rendered the prize draw unfair to all entrants. The Promoter’s decision is final with respect to any aspect of the prize draw, including the determination of the winner of the Prize. No correspondence will be entered into. If for any reason the promotion is not capable of running as planned for reasons including but not limited to tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right (subject to any written directions given under applicable law) to disqualify any individual who tampers with the entry process and to cancel, terminate, modify or suspend the promotion or invalidate any affected entries but will endeavour to minimize the effect to entrants in order to avoid undue disappointment.

The Promoter can accept no responsibility for entries delayed, misdirected or undelivered. Incomplete entries will be disqualified. The Promoter shall not be responsible for technical errors in telecommunications networks, Internet access or otherwise preventing entry to any competition or prize draw.

The Prize is as stated and is non-refundable and non-transferable. No cash alternatives will be offered. If the winner elects not to, or is unable to, use part of the Prize, the winner will forfeit that part of the Prize. If due to circumstances beyond the Promoter’s control the Promoter is unable to provide the stated Prize, the Promoter reserves the right to withdraw the Prize at any time.

The Promoter shall not be liable for any loss or damage howsoever caused (whether in contract, tort or statutory duty or otherwise) arising out of or in connection with the prize draw and/or any prize other than death or personal injury caused by negligence of the Promoter and/or the Promoter’s personnel and/or deceit or fraud by Promoter and/or its personnel.

The Promoter shall not be liable for any delay in performing or partial or total failure to perform any of its obligations to the winner under these Terms and Conditions if such delay or failure is caused by circumstances beyond its reasonable control including without limitation delays (to postal services or otherwise), changes, disruptions, cancellations, diversions or substitutions howsoever caused including without limitation as a result of war, terrorist action Page 3 of 4 or threatened terrorist action, strikes, hostilities, civil commotions, accidents, fire, flood or natural catastrophes. For the avoidance of doubt, the affected winner shall be solely liable for any additional costs incurred as a result.

Each provision excluding or limiting liability is to be construed separately and will apply and survive even if for any reason any of the other provisions are held to be inapplicable or unenforceable in any circumstances. Each of the provisions excluding or limiting liability will remain in force notwithstanding any termination of these Terms.

The surname and county of the winner can be obtained by sending a stamped, self-addressed envelope to: Waves Rush In, c/o Whole Management, METROPOLIS STUDIOS, The Power House, 70 Chiswick High Road, London, W4 1SY for one (1) month after the prize draw closes. The winner has the right to withdraw their permission to have their surname and county published.

Any personal information, including without limitation, the entrant’s name, age, address (including postcode), telephone number and/or e-mail address will be used solely in connection with this prize draw and for any purpose for which the entrant specifically opts in and will not be disclosed to any third party except for: (a) the purpose of fulfilling the Prize where applicable; and (b) for any purpose for which the entrant specifically opts in. Any personal information held by the Promoter in respect of any competition or prize draw will be held on record for a reasonable period to fulfil the purpose for which such personal information was collected and used in accordance with the Promoter’s “Privacy Policy” set out at https://wavesrushin.com/privacy-policy. To request a copy of the Privacy Policy, ask a privacy question, or exercise your privacy rights, you can write to the Promoter by post to the Promoter’s address above, marked for the attention of The Data Protection Officer or visit: https://wavesrushin.com/privacy-policy. If an entrant gives the Promoter permission to pass on their personal information to a third party then this shall no longer be the responsibility of the Promoter and shall be subject to the privacy policy of that third party.

If any provisions of these Terms are judged to be invalid, illegal, or otherwise unenforceable, then its shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect.

These Terms shall be governed by and construed in accordance with the laws of England and Wales and any disputes shall be subject to the exclusive jurisdiction of the English Courts.
